Question by blujay: My truck has accessories to acommodate my disabilities. Can a lien still be put on my Veh?
I am being sued by a Creditor Collections and have been summons to Court Hearing. I am retired and understand that my SS Income is protected, I owned my truck but it is equiped with handicapped accessories due to my disablities a driving needs can my Veh still be liened?

Yes, paying debts has nothing to do with disability. We live in a society that everything has currency and we must pay our bills no matter what the situation is. They may let you make some special arrangements but you are not immune from getting a lien.

Just some other info, I have a friend on SS retirement, she has outstanding student loans she has run from for years and refused to pay them. You cannot default on any government loan what so ever. She gets her SS check garnished every month till her loan is paid off. So, they can take your disability away.

    Your SSDI or SSI income is only protected from certain types of debts. It is not protected from debts for a car, van, or truck. Different states do have different rules regarding how much of your check can monthly be sent to pay a debt. You have to find the specific rule that applies to the state where you live.

    Of course, your disability status has nothing to do with failing to pay bills. If your SS income is protected they’ll just go after an asset that isn’t, in your case it’s your truck. If I were you, I would contact your creditors and try to work something out.

    Yes and all the accessories listed on the finance agreement. Strip it before court.
